Court rules on fly ash chelating agent patent infringement

Tokyo, Japan—The Intellectual Property High Court handed down a ruling in favor of Tosoh Corporation (Tosoh) on December 22, 2011, thereby settling a nearly three-year dispute between Tosoh and Miyoshi Oil & Fat Co., Ltd. (Miyoshi) over Japanese Patent No. 3391173 regarding a fly ash chelating agent.

The ruling concurs with the complaints made by Tosoh regarding Miyoshi and is therefore similar to the first trial ruling by the Tokyo District Court in November 2010. It deems Tosoh’s claim to the patent to be valid and stipulates that relevant Miyoshi products infringed on the intellectual property rights of Tosoh.

This long-running litigation included two appeal proceedings by Miyoshi that the Intellectual Property High Court’s ruling effectively dismisses. The ruling also awards damages, about which Tosoh will comment only after a close examination of the contents of the documents pertaining to the court’s ruling.
